Terms and Conditions

INTRODUCTION

By accessing and using the Dink App ("the Application"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Application. These Terms constitute a legal agreement between you and Rali Pte. Ltd. ("we", "us", "our", or "Rali").

2. ELIGIBILITY

You must be at least 18 years old to use the Application. By using the Application, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. USER ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. We reserve the right to terminate or suspend your account at any time for any reason without notice.

4. USER CONDUCT

You agree not to use the Application in any way that:

• Violates any applicable law or regulation
• Infringes on the rights of others
• Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Interferes with the proper functioning of the Application
• Attempts to gain unauthorized access to the Application or its systems

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RALI PTE. LTD., ITS OPERATORS, AFFILIATES, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APPLICATION.

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

YOU ACKNOWLEDGE THAT SPORTS ACTIVITIES INVOLVE INHERENT RISKS OF PHYSICAL INJURY. YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR PARTICIPATION IN ANY ACTIVITIES ORGANIZED OR FACILITATED THROUGH THE APPLICATION. YOU AGREE TO RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE RALI PTE. LTD., ITS OPERATORS, AFFILIATES, EMPLOYEES, AGENTS, OR LICENSORS FROM ANY LIABILITY ARISING FROM OR RELATED TO YOUR PARTICIPATION IN SUCH ACTIVITIES.

6. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rali Pte. Ltd., its operators, affiliates, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of the Application or violation of these Terms.

7. MODIFICATIONS TO THE APPLICATION

We reserve the right to modify, suspend, or discontinue the Application or any part of it at any time without notice or liability to you.

8. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Any modifications will be effective immediately upon posting the updated Terms on the Application. Your continued use of the Application after the posting of the updated Terms constitutes your acceptance of the modified Terms.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts of Singapore.

10. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

11. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Rali Pte. Ltd. regarding the Application and supersede all prior and contemporaneous agreements, representations, and understandings.
